Terms & Conditions
This is a mobile prepaid services provided by Mobile 8 Telco Sdn Bhd (Company number: 923675-M) (“M8 Telco”) are subject to the following Terms and Conditions:
Service
- “Service” means the mobile prepaid services provided by M8 Telco allow you (the “Subscriber”) to make and/or receive calls, SMS and data.
- M8 Telco may also include other features and services from time to time which are outlined in this website.
- M8 Telco reserves the right to modify/add/terminate services in whole or in any part at any time without prior notice.
- As a subscriber, you are responsible to equip yourself with all the necessary and compatible hardware and software to use service offered.
- By subscribing to the Service, you have warrant that you are at least twelve (12) years old and above and have parental consent to enter into such a contract.
- M8 Telco reserves the right at any time terminate and/or bar you access to the Service if you breach in any of the terms contained herein or otherwise without giving any reason whatsoever.
Subscriber Identification Module (“SIM”) card
- The SIM card is not exchangeable or transferable.
- The Subscriber must show proof of identification prior for SIM card registration.
- All SIM cards must be activated and registered within Malaysia and before the expiry date printed on the SIM card.
- For non-activated SIM card which has passed the expiry date imprinted on the SIM card and/or packaging will not be usable and/or returnable and/or refundable.
- Once activated, the SIM card will have the network access to utilise Buzzme services for up to 30 days. Without reload, account will go into grace period 1 for the 30 days where only inbound calls and SMSes are allowed. On the 61th day, the account will go into grace period 2 for 15 days where only reload is allowed. SIM will be terminated on the 75th day.
- To enjoy the Service offered, reload must be performed. SIM card shall be terminated after the 75th day if no reload is performed during the 75 days period.
- Once terminated, any remaining credit for airtime, Reward Points, SMS messages or any other service or benefits relating to the mobile number shall be forfeited.
- In the event that a SIM is lost or damaged, the Subscriber may retain his/her existing mobile number by purchasing a new SIM. Any remaining credit from the lost/damaged SIM will be refunded.
Reload coupons, softpins vouchers and online reloads
- The reload coupon offered by M8 Telco is common top up currency known as “m8”.
- The m8 is imprinted on the reload coupons and any material indicated.
- Reload coupons and softpins vouchers which have passed the expiry date imprinted on them will not be usable and/or returnable and/or refundable.
- Any value that has been reloaded is not transferable or refundable. M8 Telco will not be liable for any loss or damage due to reloading errors caused by the user of the coupon.
- The reload validity of the airtime credit is the period of time between the date of reloading and the stipulated validity period stated on the back of your reload coupon whereby you are granted access to the Services; i.e. 5 days for RM5 reload coupons, 10 days for RM10 reload coupons and 30 days for RM30 reload coupons.
(Note: The validity period of reloads purchased from the alternate reload channels will be the same as the regular reload coupons. Every time you reload, your SIM Card will compare the remaining validity period of your existing airtime credit with the validity period of your new reload. The higher of the two validity periods will be effective.)
- M8 Telco reserves the right to forfeit any remaining airtime credit after the expiry of the respective validity periods.
- Online and auto reloads on www.m8.com.my are credited directly onto the specified mobile accounts and are not refundable. Users are responsible to ensure that the mobile numbers entered are correct.
- Any reload performed using any of the alternate reload channels outlined in this website or via any other channel which may be added from time to time will be subjected to their own respective terms and conditions that are not governed by M8 Telco.
Other benefits
- Any entitlement for the benefits of programmes requiring registration will be subject to your successful application.
- Please ensure that you find out all the terms and conditions of the Value Added Services. Your usage of any part of the Services implies your acceptance of all the terms and conditions of the Services which may be changed from time to time without any prior notice.
- Subscribers are advised to reload in a timely manner in order to keep their M8 Telco Prepaid in an Active status to enjoy the value added services and benefits provided by M8 Telco and its partners.
General
- It is our policy to respect the privacy of its customers and take the issue of privacy seriously. M8 Telco will not monitor, edit, or disclose any personal information about you or your use of the Service, including its contents, without your prior permission unless M8 Telco in good faith believes that such action is necessary to:
- conform to legal requirements or comply with legal process
- protect and defend the rights or property of M8 Telco
- provide relevant part of the Service; or
- act to protect the interests of its customers or others.
You agree that M8 Telco may access your account, including its contents, as stated above or to respond to service or technical issues from time to time.
- All applicable taxes, levies and/or duties are payable by you. You must reimburse M8 Telco on demand for any such expenses which it is obliged to pay on your behalf.
- Any information stipulated in this website or any medium which may be referred to from time to time will be considered to constitute part of the Terms and Conditions as contained herein.
- M8 Telco is not liable to reimburse or compensates you for any damages, costs, expenses or loss arising from the expiration or the termination of the reload coupons or SIM Card.
- M8 Telco and its officers, employees, agents and subsidiaries shall not be liable for any loss, damage, costs, personal injury or expenses suffered by you or any third party that arises directly or indirectly as a result of the following:
- any act, omission, error, default or negligence on the part of M8 Telco or its business partners which shall not be limited to partners involved in providing/administering M8 Telco's alternate reload channels.
- any loss, distortion or mutilation of data.
- unauthorised access or usage of the Service by any third party.
- the unavailability of any part of the Service as a result of any mobile phone, inter-network or data format incompatibility, or as a result of any issues pertaining to network coverage, the unavailability of the internet or any other medium related to or required to access or use the Services or as a consequence of any other reason whatsoever.
- the nature, quality and/or effect of the Services and/or the related content.
- M8 Telco makes no warranty, guarantee or representation, expressed or implied regarding the condition, merchantability, availability or fitness of any part of the Service, any service/equipment provided by any third party that is necessary for the access and/or use of the services or for the quality of the M8 Telco network facilities or that of any other telecommunications service provider.
- M8 Telco reserves the right at any time without being liable to the Subscriber (“Customer”) to:
- discontinue, disconnect, interrupt or suspend the Service for such period of time as M8 Telco shall deem fit for any of the following reasons or any other reason whatsoever:
- to make any upgrading and/or modification to the M8 Telco system and/or the Service for its proper and efficient functioning
- for the purpose of testing or correcting any malfunctioning of the Mobile Telephone, Device or the M8 Telco system
- if the license to operate the M8 Telco system is terminated, suspended or any other action as required by the relevant authorities and/or laws and regulations
- on suspicion of fraud, or on suspicion of any illegal practice or on suspension of any unusual activity in respect of the Customer's mobile phone number with M8 Telco
- vary, add to or delete any of these Terms and Conditions with or without the need to provide any notice to the Customer and which shall take effect on such date determined fit by M8 Telco and whereby the Customer shall with continued usage of the Service shall be immediately bound by the same.
- impose a fee, extra charges and/or penalty to the Customer who misuse the free calls or SMS or data or data subscription services by the way of unauthorised selling and/or Commercial Gain.
- impose any minimum or maximum capping for the free voice, SMS, and/or data usage without prior notice to the Customer based on the fair usage policy which may be changed from time to time at M8 Telco's discretion. The data usage mentioned herein applies for both uploads and downloads. If the Customer exceeds the volume provided the Customer will be charged based on pay per use data rate which can be found in this website.
- You agree to fully indemnify M8 Telco if any fraud, misrepresentation and/or unauthorised or unlawful use of the Service by you, your agents, representatives or employees result in any loss, damage, costs or expenses to M8 Telco.
- All other terms and conditions stipulated in www.buzzme.com.my and the data Usage Policy apply.
- M8 Telco shall not be responsible in any way in the event that the Subscriber's subscription was activated by a third party without their consent. M8 Telco shall not refund nor compensate the Subscriber in any manner whatsoever in such situations.
- This service is provided on an "as is" basis and M8 Telco does not guarantee or warrant that there shall be no problems, defects or errors in the usage provided by this subscription. M8 Telco shall not be responsible in any way whatsoever for the loss incurred directly or indirectly for such failure or any problems associated to the network in any way whatsoever.
- These Terms and Conditions will be governed by the laws of Malaysia.
- The Terms and Conditions herein are subject to change without prior notice.
My BFF
- This Service allows Subscriber to enjoy discounted rates to their registered numbers via USSD menu (“Buzzme menu”).
- Each Subscriber can register up to ten (10) My BFF.
- Every modification after the 10th My BFF number will be charged RM2.00 for each number change.
- In the event the Subscriber changes his/her call plan, at M8 Telco's discretion, the BFF numbers may be removed. Resetting of the BFF numbers shall require the Subscriber to key in all their BFF numbers again.
- M8 Telco reserves the right to alter any part of the Service and/or the pricing structure at any time without prior notice.
Data
- Data pay per use usage is charged RM0.05/MB for domestic usage.
- Data usage is based on 1MB charging block.
- For any promotion in the purposes of data subscription, any free Internet usage and/or Free airtime (in RM) granted to Subscribers at any point shall not be taken into consideration.
- The data service is optimised for Internet browsing on the mobile phone and/or mobile devices and it is not intended for peer-to-peer or file sharing applications.
- M8 Telco reserves its absolute right and discretion to apply the Data Usage Policy if the Subscriber is suspected to have had abused the Internet usage in whatsoever way including but not limited to exceeding the maximum usage limit subscribed wherein M8 Telco may block the Subscriber's Internet usage.
Benefits - Reward Points and PA Insurance Coverage
- The Subscriber is entitled to Rewards Points based on eligible calls, SMS and data Pay Per Use usage locally.
- Reward Points are earned based on eligible usage made by the Subscribers. The calculation of the points is subject to M8 Telco discretion.
- These Reward Points can be redeemed for airtime usage via USSD Menu Browser or selected items on www.m8.com.my.
- The expiry of the Reward Points follows the main validity of your Plan.
- M8 Telco reserves the right to forfeit any remaining airtime credit and Reward Points after the expiry and/or termination of the respective validity periods.
- Subscribers who meet the eligibility requirement as stated on the free Personal Accidental (PA) insurance are automatically insured on the following calendar month.
- Subscribers are advised to reload in a timely manner in order to keep their M8 Telco Prepaid in an Active status to enjoy the value added services and benefits provided by M8 Telco and its partners.
- M8 Telco reserves the absolute right to:
- alter any part of the Services/Benefits and/or the pricing structure of the Services at any time without prior notice and
- disqualify subscribers from enjoying any benefits if foul play is suspected/confirmed.
Commercial Gain
Commercial gain shall mean any form of profits earned and/or gained and/or likely to be gained by the Customer directly and/or indirectly with or without intention of gaining profit arising from the usage and/or utilisation of the Service with any unauthorised device or any other ways in any manner whatsoever which unfairly exploit the unlimited free voice and/or data usage (as and when it is made available by M8 Telco in any of its promotions, plans and/or packages) or spamming activities for the purposes of unauthorised reselling. For the avoidance of doubt, commercial related Short Message Services (SMS) sent by the Customer under this plan shall be deemed as a breach of these terms and conditions.
M8 Telco reserves the right at any time without being liable to the subscriber or any third party whatsoever, to:
- Impose a fee, extra charges and/or penalty to the subscriber who misuse the free calls or data services by way of unauthorised selling and/or Commercial Gain.
- Impose any minimum or maximum capping for the free voice and/or data usage without prior notice to the subscribed which may be changed from time to time at M8 Telco's discretion.
- M8 Telco reserves the right to suspend and/or terminate the line in the case of suspected commercial gain activity not limited to any voice and/or data services and promotions being offered.
Charges and billing
- M8 Telco reserves the right to alter any part of the Service and/or the pricing structure at any time without prior notice.
- M8 Telco shall not be liable for any loss, damage, costs or expenses arising from your failure to do so.
- You may dial *126# or *122# for the latest information of your main account and airtime credit.
3rd party Products and/or Services
- M8 Telco shall not be responsible or liable for any third party services and/or products which you access, use, acquire using M8 Telco Service.
Proprietary Rights
- All Trade Marks displayed in this website and/or the Services are the trademarks of M8 Telco and its parent company. The trademarks of M8 Telco may not be copied, or used, in whole, partial or modified form, without the prior written permission of M8 Telco or, if applicable, its licensor.
You have acknowledge and agree that the Services and/or any part thereof, whether presented to you by M8 Telco, advertisers or any third party are protected by copyrights, trademarks, service marks, patents, or other proprietary rights and laws. All rights are expressly reserved.
